Release and Waiver of Liability In consideration of being allowed to access and use the Brain Type Test, you hereby release, waive, discharge, and covenant not to sue Trinity Fitness Inc., its owners, employees, affiliates, or agents (collectively, “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death, whether caused by negligence or otherwise, that may be sustained by you while using the service or following its suggestions. This includes, but is not limited to:

• Any physical, mental, or emotional harm from fitness/nutrition habits and/or brain rewiring or brain training.
• Inaccurate or misinterpreted test results.
• Data loss, privacy issues, or technical errors.
• Any indirect, incidental, consequential, or punitive damages. This release extends to all claims, even those not yet known or suspected, and applies to the fullest extent permitted by law.

4. Indemnification You agree to indemnify, defend, and hold harmless the Released Parties from any claims, losses, liabilities, damages, costs, or expenses (including attorney’s fees) arising from your use of the service, violation of these terms, or infringement of any third-party rights (e.g., sharing proprietary test content without permission).

5. Intellectual Property All content in the Brain Type Test, including questions, results, and recommendations, is the proprietary property of Trinity Fitness Inc. and protected by copyright and other intellectual property laws. You agree not to reproduce, distribute, or commercialize any part of it without written permission.

6. Governing Law and Severability This waiver shall be governed by the laws of Washington State, without regard to conflict of laws principles. If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force. This waiver constitutes the entire agreement between you and Trinity Fitness Inc. regarding liability.
